What about an immigration system based on love and forgiveness instead of fear and vindictiveness? Are the punishments for immigration offenders fair in comparison to the offense? What do you think?

Forgiveness sets us free. Everyone knows that right? Then why are aspects of our immigration system so unforgiving? If you overstay a date certain listed on your entry document for six months, you will be barred for three years. If you overstay for one year, you will be barred for ten years. If you enter without inspection and then leave and enter again unlawfully, you are subject to a permanent bar. If you make a false claim to U.S. citizenship even just by checking the wrong box on a form, you could be barred permanently from the U.S. I actually just talked to an individual who received a finding of misrepresentation at the Embassy because she brought her laptop and allegedly worked for one of her US clients on a visit to the US. She was a remote content creator and served clients all over the world. She went for a visit to the US and violated her visa by sending a few emails and creating a few social media posts and now she is barred for ten years. Elon Musk, his brother, and the rest of their family are immigrants. They made mistakes and their immigration status was "a gray area" as Elon stated in a 2013 interview. His brother openly admits that he was an illegal immigrant, whatever that means. Elon later alludes to the fact that he was on an F-1 student visa, but was not studying. Instead he was working to create his first start up. See the story here: https://lnkd.in/e7EKSjXB Luckily, his immigration misteps were either not serious or were forgiven and he is now a US citizen. The point is life is messy and things don't always go as planned. The point is we are all humans. If you read my post the other day. They admitted that they messed up when it came to immigration. However, they were able to figure it out and make huge contributions to our global society. Why can't we be more compassionate and forgiving with our immigration policies? We have a system that created ultra severe penalties to deter people from violating our immigration rules. All these punishments do is separate families and cause heartbreak and don't do too much to protect the U.S. or deter future immigrants from being imperfect. There is a kinder, gentler immigration system. A system based on love and forgiveness, rather than hate and vindictiveness. This is my dream. A more loving and connected world where decisions are made based on love and purpose instead of fear. The upside in this immigration story is that dreams do come true sometimes. I am an immigration lawyer! Immigration is my passion! But I haven't been posting much lately about my experiences as a practicing immigration attorney. I love to post about my spritual journey and my quest to create the happiest law firm in America. I think though, now is time to get technical. And talk about immigration. How about a series that highlights the upside of immigration?? That seems to fit in with the vibe I want to communicate on Linkedin. I will fill you in on cases we are winning, our unique creative immigration solutions and all the positives I see in the world of immigrants and immigration. One of my favorite parts of my immigration practice is the work we do with international medical graduates (IMGs). If you did not know, we have a pretty serious shortage of physicians in the U.S. these days. According to new projections published by the AAMC (Association of American Medical Colleges), the United States will face a physician shortage of up to 86,000 physicians by 2036.? See the article here: https://lnkd.in/eStyEG3D Of course, the U.S. is increasing enrollment in medical schools and plans to expand graduate medical education to meet this need. The population is aging and people are living longer and need care. Many hospitals and medical practices have come to rely on IMGs to meet their immediate needs for competent caregivers. That is where we come in. We help these IMGs and their employers navigate the immigration process. The upside here is that this is one area where I feel like we can be successful as immigration lawyers. Many hospitals are not subject to the H-1B cap so we can get H-1Bs at any time for these doctors. If the doctors are on the J-1 visa for training and receive a waiver of the two year foreign residence requirement then they are not subject to the H-1B cap. When expedites are needed for our doctors, we usually have good evidence of the humanitarian need and we are able to expedite cases, work permits or consular appointments if necessary. Many of our physician clients are highly skilled and highly successful and qualify for alternative types of visas like the O-1 Extraordinary Ability. These doctors often can skip over the labor certification process because they qualify for the Physician National Interest Waiver, the regular National Interest Waiver or the EB-1 Extraordinary Ability green card. Immigration regulations can be a bit restrictive for foreign physicians, but there is a lot of good we can do to make sure we keep access to healthcare in the U.S. and especially in underserved areas. I love talking and bragging about my physician clients and their employers. They are serving and saving lives of U.S. citizens every day. That is certainly an upside to immigration! The October Visa Bulletin is out! There is some forward movement and we are able to use the Dates of Filing Charts for this month in both family and employment based preference categories. But this month's bulletin shines a spotlight on the problem that is pervasive in our immigration system. We just don't have enough immigrant visa numbers! October marks the beginning of the 2025 fiscal year and it seems that USCIS has enough employment based adjustment of status applications in the pipeline for this entire fiscal year. Many Indian nationals even in the EB-1 category will wait three or more years for current priority dates. Commentary on this topic, the delays, the backlogs is just depressing. Lawyers are projecting and predicting 100 years waits in some categories. I tune out this negativity. I can't live in such despair and doom and gloom. So I choose hope. I choose miracles. There is always hope. Our past does not predict our future. There are infinite possibilites in the universe and this could be fixed in the near future. We have to stay in hope and possibility. We have to believe in miracles! Especially when it come to the Visa Bulletin! WE ALWAYS HAVE HOPE! THERE WILL BE A SECOND SELECTION IN THE H-1B LOTTERY FOR FISCAL YEAR 2025! See the news from USCIS below: In March, USCIS?conducted?an initial random selection on properly submitted electronic registrations for the fiscal year 2025 H-1B cap, including for beneficiaries eligible for the advanced degree exemption. Only those petitioners with selected registrations for FY 2025 are eligible to file H-1B cap-subject petitions during the filing period on their registration selection notice.?The initial filing period for those with selected registrations for FY 2025 was from April 1 through June 30, 2024. We recently determined that we would need to select additional registrations?for unique beneficiaries to reach the FY 2025 regular cap numerical allocation. Soon, we will select additional registrations for unique beneficiaries from previously submitted electronic registrations using a random selection process, and we will notify prospective petitioners with selected registrations from this second round of selection that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration. We will announce when we have completed this second process of selections and notifications. We will not be conducting a second selection for the advanced degree exemption (the master’s cap), as enough master’s cap registrations were already selected and sufficient petitions were received based on those registrations as projected to meet the FY 2025 masters cap numerical allocation. The second round of selection for the regular cap will include previously submitted registrations that indicated eligibility for the master’s cap along with those that indicated only eligibility for the regular cap. Those with selected registrations will have their?USCIS online?accounts?updated to include a selection notice, which includes details of when and where to file. I am so lucky. Fortunate to be part of the immigration bar that is filled with attorneys always ready to provide advice, discuss case strategy and share experiences. Of course, we, as lawyers, are trained in law school to see every worst case scenario, advise of all the risks and warn of the problems that could lay ahead. Clients need to know the risks of the steps that they are taking in their immigration journey. Sometimes doing our job as lawyers seems so negative, hopeless and fear almost panic inducing for the client (and even the lawyer.) We feel compelled to prepare our clients for the worst and we lose sight of the humanity of the client sitting before us. We can descend into fear and let that be our north star instead of hope and love. We let past negative outcomes predict and even create the future when no one really knows the future. The energetic frequency of fear is very low at 100HZ while the frequency of love is 528HZ. The love frequency is considered to be the most powerful frequency. When we stay at the energetic frequency of love, we are in a state of harmony and interconnectedness with our surroundings. We feel safe, secure and have an inner trust and knowing that everything will work out for our good. When I talk about practicing law with love. This is what I mean. We know the law. Recite the facts Expect Miracles. We stay in the frequency of love. We make decisions from love and not fear. We show up with the high vibrational energy of love. I am not saying this is easy. It is a skill we must develop as lawyers. A reprogramming of sorts. When we are able to change our energetic state, everything around us changes, including amazing outcomes for clients. It happened again last Friday. We had to send a client abroad to the consulate to obtain an E-2 visa after an adjustment of status denial a few months before. My colleagues warned me of the risks that this visa would be denied based on immigrant intent. We planned, researched and felt confident that we had a chance at obtaining the visa. The E-2 visa is a semi dual intent visa and there was a definite possibility that the visa would be granted. We advised our client of the risks and prepared him for his interview. The stakes were high. He could be stuck outside the U.S. for many months if this visa was not approved. I visualized the moment I received the news that the visa was approved. I believed and I knew and I did not let fear lower my frequency. I surrendered. I detached from the outcome. Because I knew. Just as I envisioned, a text came through on Friday morning. Visa approved! We took a risk. We knew what could happen. But we chose to focus on the possibility. We chose to stay in the frequency of love. This is how we practice law with love.
