    IP IN SPORT. My experience as a Quarterfinalist at the maiden edition of the Football Law Annual Moot(FLAM) exposed me to the world of football and sports law and immediately my brain started connecting dots- The connection between Intellectual Property and Football. One may think competitive sport is all about passion! The love of the game, the dedication to the craft and giving your heart to the badge. Or in other words, the club's official logo. But not exactly. Behind every sports establishment is a business and with business comes branding. That's where Intellectual Property creeps in. Club logos and Slogans that form part of the club's identity are all registered as part of the club's trademark. However, for a slogan to be eligible for trademark protection, it must be distinctive and not merely descriptive. “You will never walk alone” is a fine example. The case of BOSTON PROFESSIONAL HOCKEY v. DALLAS CAP & EMBLEM (although focused on hockey)sets a precedent for protecting sports logos under trademark law, influencing similar disputes in football. We should also remember that laws relating to trademark and other intellectual property rights tend to be territorial in nature. In Europe, a legal right of personality(which is called image right in some territories) is recognized and safeguarded under the constitutional rules of the country concerned. For example, in Germany, Articles 1 and 2 of the Constitution protect image rights. Thus, Oliver Khan, the former German national goalkeeper, successfully sued Electronic Arts(EA) the well-known games manufacturer, for using his name and image in an official FIFA Computer Football game without his express consent (Kahn v Electronic Arts GmbH, unreported, 25 April 2003). Next time you turn on the game to watch Monday night football, remember you are not just watching 22 men run around the pitch kicking a ball. You are watching a brand, a business establishment, well protected by various Intellectual Property Rights.
