Congrats to Attorney Jake Sitman and the Employment Law team for their recent litigation win! ?? ??BACKGROUND: Our client, a Lehigh Valley restaurant, faced multiple claims of violated wage payment laws by withholding and allegedly failing to pay tips to wait staff. The restaurant charged patrons holding banquets, parties and other events at the restaurant for food and drinks a service fee, as well as an additional “gratuity.” ?ARGUMENTS: According to the federal court complaint, the service fee was a “tip” that should have been paid to the wait staff. However, FLB/Jake argued that the service fee was not a tip or wages due and payable to employees under the law because the fee charged by the restaurant was mandatory, and patrons had no discretion as to whether to pay the fee or the amount of the charge. ??OUTCOME: The court, agreeing with FLB, and dismissing all of the tip payment claims, found that the additional amount charged to patrons was a service fee, rather than a tip that had to be paid to employees.
