Glitz! Glamour! Title Insurance Scandal??Welcome to Hollywood. In August, the The Wall Street Journal shared how scammers tried to sell Graceland. This time, a legendary L.A. mansion is the target. Sarah Frano, vice president and real-estate fraud expert at First American Title, shares with Wall Street Journal that due in part to changes in technology, there has been a sharp increase in title fraud and seller impersonation across the country in recent years. In fact, 28% of title companies reported at least one seller impersonation fraud attempt in 2023. Stay vigilant by regularly reviewing county records to verify your title, setting up a Google alert of your property’s address to catch any suspicious activity, monitor your credit report for any changes and of course, utilize a professional service to purchase a title insurance policy with fraud coverage. A recent white paper from our Chief Economist Mark Fleming estimates that the industry's efforts to maintain accurate and reliable property records mitigate an astounding $600 to $900 billion in risk exposure annually for home buyers, lenders, and other participants in real estate transactions. Breaking "news"! The U.S. residential real estate market accounts for a significant share of the total economy, but it relies on a public good – reliable, accurate real property records – that the title insurance industry maintains. Title insurers play a foundational, but largely misunderstood, role in the real estate industry. It is the industry’s efforts to curate that public good and mitigate title risk exposure that maintains the existence of the reliable and accurate property ownership records underpinning the real estate economy. I have just published my research (see the complete white paper below) on the value of that role. It estimates that the title insurance industry’s work to maintain accurate and reliable property records mitigates $600 to $900 billion in risk exposure to home buyers, lenders and other participants in real estate transactions. When the price of maintaining a public good that is central to a smooth-functioning real estate economy is just pennies on the risk-dollar, do we really want?to jeopardize that public good and risk diminishing the economic benefits it provides? Top Conclusions: ·??????Annually, prior to the pandemic, the title industry’s estimated pre-curative risk exposure ranged from $600 to $900 billion a year. ·??????During the boom in sales and mortgage refinancing in the pandemic total estimated industry risk exposure surpassed $1 trillion a year. ·??????The degradation over time of the public records, if not curated, will cause the marketability of title to become less clear and increase the burden of defending property rights in court. ·??????The price for curating the public record and insuring ownership rights relative to the total estimated risk exposure is small.
