    ?? The latest Congressional Research Service report on de-banking and de-risking highlights a persistent challenge in financial access: the gap between perceived vs. actual risk. Entire industries—from crypto and MSBs to low- and moderate-income communities and remittances—often face exclusion due to compliance concerns driven by perception rather than practical, ongoing evidence. Yet, despite increasing regulations and rising compliance costs, illicit activity and fraud persist in the financial sector, proving that exclusion isn’t the answer. Financial institutions often de-risk due to reputational concerns, historical biases, or regulatory uncertainty—rarely due to actual risk. Many providers make a business decision to avoid certain client segments, deeming the regulatory scrutiny and compliance costs too high. Regulators and enforcement authorities have often reinforced this caution, discouraging engagement with specific activities or customer types. However, modern compliance solutions can bridge this gap—enhancing security, increasing transaction throughput, and improving transparency without restricting access! At FinClusive, we believe the most efficient and secure way to address this challenge is by embedding modernized compliance tools.     President Trump’s “Strengthening American Leadership in Digital Financial Technology” executive order marks a significant shift in the U.S. approach to #DigitalAssets. By prioritizing innovation, regulatory clarity, American competitiveness, and the sovereignty of the U.S. dollar, this order sends a strong signal of support for the sector. While these are welcome developments from a proactive administration, two key concerns must be addressed to ensure a comprehensive and effective approach: ?? CBDC Ban: The outright ban on central bank digital currencies (CBDCs)—including their study or development—risks U.S. competitiveness. With 130+ countries studying or deploying CBDCs, the U.S. must engage in this dialogue. Exploring diverse forms of digital dollars—such as stablecoins for payments, tokenized deposits for efficient intrabank operations, or wholesale CBDCs for reserve digitization—can unlock significant opportunities across various use cases while safeguarding privacy. ?? Regulatory Gaps: The creation of a Presidential Working Group on Digital Asset Markets within the National Economic Council is a positive step toward fostering a cohesive federal framework and addressing challenges like the derisking of digital asset services. However, the inclusion of the #SEC and #CFTC as members, while excluding federal banking agencies, is concerning. Too often, digital assets are assessed solely through the SEC and CFTC lens, which lack jurisdiction over payments. Including banking and payment regulators, such as those under the #FFIEC, would ensure that regulatory guidance aligns with the diverse use cases of digital assets, from payments to tokenization. While the revocation of prior federal executive orders and regulatory guidance may disrupt continuity, this new order offers an opportunity for the U.S. to lead in digital finance with a forward-looking and balanced approach. At FinClusive, we remain committed to advancing practical use cases and collaborating with the government and industry to drive innovation while safeguarding consumer protections and financial system stability. We are eager to see the practical steps for implementing this new order and offer the administration—and the new Congress—our continued support.

    ?? New #Cybersecurity Executive Order: Progress on #DigitalIdentity ?? The White House’s latest cybersecurity executive order, issued last week, marks a significant milestone in tackling the escalating threats in the digital world, including identity-related cybercrime. This EO addresses many critical issues FinClusive has highlighted in guidance to legislators and regulators, emphasizing the national security implications of digital identity and security in the open web. We’re proud to see our contributions reflected in this important progress. Congratulations to the practitioners at the White House and industry leaders who played a key role in shaping this initiative! Adversaries and organized crime have been exploiting compromised identities across sectors such as government benefits, banking, fintech, crypto, healthcare, and more. This EO establishes a much-needed foundation for strengthening digital identity infrastructure. It emphasizes the importance of digital identity and verification technologies and processes that achieve two critical goals: combating threats like fraud and identity theft while enhancing #ConsumerProtection and #privacy. These principles are integral to modernizing digital identity and enabling greater trust within highly regulated industries like #FinancialServices. While more work is needed to develop a comprehensive digital identity strategy, this EO is a significant step forward. We urge President Donald Trump’s new administration—amid its efforts to reignite U.S. technology leadership—to ensure that advancing digital transformation includes modernized digital identity solutions. These solutions should uphold U.S. privacy interests, enhance Americans' security in the digital domain, and revitalize U.S. competitiveness. At FinClusive, we remain committed to supporting policymakers and the broader ecosystem in advancing robust, privacy-first solutions that protect Americans from identity theft and cybercrime. We look forward to building on this EO to enhance trust frameworks in critical industries such as payments and open banking.
