FINTRAC published today a new Operational Alert to support businesses in recognizing and reporting financial transactions related to the laundering of the proceeds of fentanyl and other illegal synthetic opioids. Reporting from businesses will facilitate the production of actionable financial intelligence in support of law enforcement investigations and prosecutions of this appalling crime that is fuelling a public health crisis in North America. This Operational Alert is the result of the trilateral cooperation between FINTRAC, the Financial Crimes Enforcement Network, US Treasury (FinCEN) in the United States and the Unidad de Inteligencia Financiera in Mexico. These Financial Intelligence Units have come together to form the North American Drug Dialogue Illicit Financing Working Group to develop money laundering indicators related to the importation, production and distribution of illegal synthetic opioids; share money laundering trends, typologies and best practices; and instigate and support law enforcement investigations. This Operational Alert supports Project Guardian, a broader public-private partnership established in 2018 to target money laundering activities linked to the importation, production and distribution of illegal synthetic opioids. Project Guardian is led by CIBC and includes financial intelligence units, law enforcement agencies and private sector partners. In 2023–24, FINTRAC provided 93 disclosures of actionable financial intelligence to its law enforcement partners in support of Project Guardian. These disclosures contained information on 354 different subjects and supported 53 law enforcement investigations. Since the launch of Project Guardian, FINTRAC has generated nearly 1,000 financial intelligence disclosures in relation to illegal synthetic opioid trafficking. Please note that beneficial ownership information reporting requirements have been affected by a recent federal court order. The Department of the Treasury is appealing that order. In the meantime, reporting companies are not currently required to file a beneficial ownership report (BOIR) and are not subject to liability if they fail to do so while the applicable order remains in force.
