Yesterday, President Biden granted the largest single-day clemency in modern history—commuting nearly 1,500 sentences and pardoning 39 individuals. We commend this bold step toward justice and reconciliation, especially for those sentenced under outdated drug laws that have devastated families and communities. While we recognize this progress, it’s important to note that earlier action could have had a greater impact. Had this clemency come sooner, it could have served as a powerful example for state leaders and policymakers to implement similar changes at the state level, where most incarcerated people remain. Clemency can right past wrongs but cannot restore the years of life lost, the futures taken, or the family connections severed. Thousands of people are still behind bars for offenses that are no longer considered crimes, and 40 people remain on federal death row. As President Biden’s term comes to a close, we call on him to continue using his clemency power to dismantle outdated sentencing laws, end the death penalty for federal cases, and push for system-wide reforms. This moment must spark a broader conversation about the cost of incarceration—not just for those behind bars, but for their families, loved ones, and entire communities. Clemency is not a privilege—it is a necessary tool for justice.
