On March 17, 2025, Senior Counsel Anthony LaScalea secured a Summary Judgment victory for our clients in a high-stakes commercial vehicle accident in Bowie County, Texas. The Plaintiffs, seeking over $1 million in damages, claimed negligence in hiring, training, retention, supervision, and maintenance. After 22 months of discovery, depositions, and expert testimony, the Court found that Plaintiffs evidence was insufficient to survive Summary Judgment, dismissing the case in its entirety, prior to jury selection. Prior to pre-trial arguments, Plaintiffs made a $2 million settlement demand, which was rejected by Defendants. This win was a team effort, with special recognition to paralegal Jennifer French for her outstanding contributions.

Equity Partner Daniel Karp secured a complete defense verdict and a $1 million award on a counterclaim for our client. She was falsely accused of assaulting a co-worker, facing attempts to revoke her medical license, prosecute her for felony assault, and destroy her career. The District Attorney dismissed the criminal case, and the Texas Medical Board cleared her name. Scott Palmer, of Palmer Perlstein who represented our client in her criminal defense joined the civil case, filing a counter-claim for malicious prosecution. At trial, the jury saw through the false accusations, recognizing the years of bullying, harassment, and emotional abuse our client endured. They held the Plaintiff accountable for malicious prosecution and intentional emotional distress. In a bold statement, the jury awarded our client the exact amount Plaintiff’s counsel had sought in punitive damages—$462,022—proving that justice prevails.

A big win for contractors in Texas. Fee, Smith & Sharp LLP won an appeal for its construction client in the 14th Court of Appeals in Houston. Senior Counsel Justin Diaz filed and argued on behalf of our client that the trial court wrongfully granted a motion to dismiss, dismissing all of its claims for attorneys’ fees as the prevailing party in a take-nothing arbitration award. The 14th Court of Appeals agreed, reversed and remanded the trial court’s order. Congratulations, Justin!

Senior Partner Ian Beliveaux recently represented a builder and homeowner against claims related to the alleged diversion of surface water during the construction of a residence along the shores of Lake Conroe.?After three days of trial, the court granted a directed verdict on all claims.?It determined plaintiffs failed to offer any evidence that the defendants unlawfully diverted surface water and that their liability expert's opinions were "no evidence" and could not support a judgment.
