  • How should federal employees respond to executive orders that impact their jobs? In a recent Business Insider interview, Debra D’Agostino, founding partner of Federal Practice Group, explained how recent executive orders are reshaping the federal workforce and what employees need to know to protect themselves. Many federal workers are facing hiring freezes, return-to-office mandates, and forced reassignments. Some are unsure whether they can challenge these directives, but timing is critical. Debra’s key advice is simple: “Comply now, complain later.” While these orders may seem unfair, refusing to comply could cost employees their jobs and limit their ability to challenge them later. Following directives first prevents immediate consequences, but employees should also document potential violations and be prepared to file complaints through the proper legal channels. Workplace protections still exist, but many employees do not realize when they have grounds for an appeal. Failing to comply with an order could be seen as insubordination, making it much harder to contest later. A federal judge has reinstated Cathy Harris to the Merit Systems Protection Board (MSPB) after she was abruptly fired via email by the Presidential Personnel Office. President Biden appointed Harris to a seven-year term, with four years remaining, and the court ruled that her removal violated the law, which states that MSPB members can only be removed for inefficiency, neglect of duty, or malfeasance in office.? ? DOJ argued that President Trump had the authority to remove Board members at will, but the judge rejected this claim, finding no legal authority to support it.? ? This ruling is a significant victory for the rule of law and a strong pushback against the idea that a President can remove independent agency watchdogs without cause.
