A great article by Guy DeMarco about #massarbitrations. Recent lawsuits against ADR providers and plaintiffs' firms underscore a growing problem: mass arbitration, when misused, becomes less about resolving disputes and more about driving up costs. The current system often forces companies into an?untenable position—paying exorbitant fees upfront from a flood of claims, many of which may be unverified. Arbitration should provide a fair, efficient, and cost-effective alternative to litigation. Instead, as these cases highlight, it’s been “weaponized” in ways that undermine its original intent.
