8 Reasons why every single website and mobile app (including yours) needs a Terms of Service (TOS) and Privacy Policy. Reason #8 – To Customize to your business and your situation. Good legal policies are not just copied from another site (in fact, to do so might violate copyright law). Rather, the best terms should ideally be customized for your situation, industry, business model, features, content, etc. Among other things, this customization might include any appropriate disclaimers - often based on your specific industry or business model. For example, as touched on in Reason #5, publishers may not be liable for “user generated content” or “UGC”, so long as they have the correct “safe harbor” language for this disclosure to be effective. You also need to customize your terms based on what you do, what the content is on your site, etc. Do you use social media plugins or other third party APIs? Are your services b2c or b2b? Do you allow your customers to redistribute your content or not? Do you sell something or match buyers and sellers of third party products that are not your responsibility? Is your website or app in a high risk or highly regulated sector that might require unique disclaimers, such as medical services, financial services, politics, charitable donations, etc.)?
