Our roots (since 2002) have been blending the art and science of direct response digital advertising. Throughout our time in the digital space, we've managed over 2,000 campaigns across all digital channels (SEM, SEO, Display, Affiliate, Lead Aggregators, etc.). Over the past five years we started seeing more and more clients starting to use lead aggregators but managing them was a real challenge. How to manage 5+ vendors all using various publishers and sub publishers, dealing with make goods, vendor optimization and how to match back each partners front end performance to our clients back end success metrics were all challenging. That's why we started Exact Customer!

These changes are particularly relevant for data brokers operating in the state. What Constitutes a Data Broker? - Knowingly collects consumer personal information - Lacks a direct relationship with the consumer - Sells personal information to third parties - A direct relationship is established when a consumer interacts with a business for its products or services within three years Key Compliance Steps for Data Brokers: Registration Requirement: Register with the California Privacy Protection Agency (CPPA) by January 31, 2025, providing detailed operational information. Data Collection and Storage: Maintain detailed records of data collection practices, including types of personal data collected and shared. Reporting Obligations: By July 1, 2025, report consumer request metrics on their website and disclose response times. This will need to be updated annually! Consumer Rights Compliance: Ensure processes for opting out of data sales and correcting inaccurate information. Penalties for Non-Compliance: Failure to register can result in administrative fines. These regulations underscore California's commitment to consumer privacy and transparency. Compliance is essential for data brokers to maintain trust and avoid penalties.     The Wicked Witch Is Dead! The Eleventh Circuit has vacated the FCC's "1:1 consent rule" under the TCPA. Here's what this means for our industry: Key Points: The "prior express written consent" for autodialer or pre-recorded voice calls/texts no longer requires consent from one seller at a time on a medium related to the call's substance. Companies can continue lead generation and calling practices as before, with some caveats, meaning they do not need direct One-to-One consent. The court ruled that the FCC exceeded its statutory authority, as the TCPA only requires "prior express consent," not additional restrictions. Implications: Consent can be obtained for multiple entities simultaneously if properly disclosed. Consent can be gathered on mediums not directly related to the call content (e.g., mortgage calls consent on an insurance website). The ruling emphasizes "clear and unmistakable" consent to receive robocalls.
