In January, Pipeline and Hazardous Materials Safety Administration (PHMSA) released a Notice of Proposed Rulemaking (NPRM) aimed at enhancing safety standards for Carbon Dioxide (CO?) and Hazardous Liquid Pipelines. This proposal aligns with new climate initiatives and lessons from past incidents, like the 2020 Satartia rupture. Key Proposed Changes: -Expanded Coverage – Stricter safety and reporting standards for gas- and liquid-phase CO? pipelines. -Emergency Preparedness – Required emergency planning zones and public communication upgrades. -Fracture Control – More prescriptive pipeline integrity requirements. -Operational Improvements – Enhanced right-of-way inspections, vapor dispersion modeling, and alarm systems. However, due to the "Regulatory Freeze" Executive Order, this NPRM is currently on hold. Comments were originally due 60 days from publication, but it remains unclear when rulemaking will move forward. Here’s the scoop:?random drug testing?for 2025 is rising to?50% ? Operators of gas, hazardous liquid, and carbon dioxide pipelines, liquefied natural gas (LNG) plants, and underground natural gas storage must conduct random drug testing for prohibited substances as required by 49 CFR Part 199. ? The minimum annual random testing rate is determined by the Administrator based on industry-wide positive test rates reported in annual DAMIS submissions (§199.119(a)). ? In accordance with §199.105(c), if the positive rate is below 1% for two consecutive calendar years, the testing rate may be reduced to 25%. Conversely, if the positive rate meets or exceeds 1%, the rate must increase to 50%. ? For CY 2024, the random testing rate was 25%. However, CY 2023 DAMIS data showed a positive rate above 1%. ? As a result, the minimum random?drug testing?rate for?2025?will increase to?50%?of?all covered employees.

Under the requirements of § 192.745(b), operators must take prompt remedial action to correct any valve found inoperable, unless an alternative valve is designated. This regulation ensures that operators maintain the functionality of critical valves, particularly those designated as emergency valves, to ensure safety and compliance. When a valve cannot be repaired or rendered operational, the designation of an alternative valve is essential to avoid operational vulnerabilities and mitigate risks. In a recent Notice of Probable Violation that includes a Proposed Civil Penalty of $50,200.00, an operator failed to take effective remedial action regarding the operability of block valve. The records included multiple work orders spanning three years. Despite attempts to repair the valve’s hand pump, it remained inoperable during annual inspections in 2021, 2022, and 2023. The hand pump is essential for manual actuation, was unable to close the valve in the field. Although the operator reported successful remote operation of the valve via the control room, the lack of a working manual mechanism introduced significant risk. If control room telemetry were interrupted, field personnel would have no reliable method to stop the flow of gas, compromising emergency response capabilities.
