Don’t you love this moody Cape Town sunset? I was in nine African countries at once this #fraudweek, but only in one in person! How? While ‘Don’t Be Fooled, It’s Fraud!’, the Ethicalways - Engaging Workplace Integrity video-based e-learning programme continued to be rolled out to financial services sector employees in Kenya, Uganda, Rwanda, Tanzania, South Sudan, Malawi and Mozambique as well as here in South Africa, I had the exceptionally good fortune to be presenting at and attending the 4th Africa Directors Summit in Cape Town. Board members, executive / non-exec and independent directors from across sub-Saharan Africa spent four days grappling with key governance issues and learning from one another. Thank you to event organisers par excellence Bussynet Advanced Trading and the most engaged, dedicated and warmly welcoming directors from around the region. It was inspiring to meet governance specialists and experienced board members from so many countries, just one of whom was Ana Major from Angola with deep oil and gas sector governance experience. #ethics #governance

Supplier vetting will identify corruption risk (if you do the basics) This is how you can spot the corruption in high risk environments. Let me explain… With a case example. A company was referred to the procurement department by a project manager as ‘a great company that they personally knew and would be of great value in specific urgent requirement, direct award contracts. The supplier was taken on without any checks. Within the first 3 months the new contractor received contracts valued at $200k. It was only when other contractors raised concerns about the project manager's cosy relationship with the contractor that, staff started paying attention. So… The first statement you need to remember is that ‘trust’ is not a control measure. What are the simple checks? Check the national company register to verify the following information. ↘Company formation date ↘Financial standing ↘Executives and shareholders With this check you would have identified a number of corruption risk areas. Firstly, that the company didn’t exist a week before the award of the first contract. So... the project manager lied about their knowledge of the company and its ability to perform the contract. Secondly, that one of the shareholders was the head of security on the project, that if known would have meant their removal from the project and the contractors debarment. If supplier executive and shareholder information was obtained during the vetting process, and checked against staffing information for data matches, it would have identified that the owner of the company and the head of security lived next door to each other. It is clear from this personal relationship as neighbours that they hatched a plan to create and introduce a supplier for the purpose of committing fraud. However… it was the project manager who identified the requirement and confirmed its completed. These initial works valued at $200k were paid for without work ever being carried out. The bribe payment… Using shares as a kickback is a common global theme, receiving monies through annual dividends. No action was needed by the head of security, only his subtle services in identifying potential contracts or sub-contract opportunities and building relationships with contractors in his role to gain intelligence on potential future works and passing it onto the company owner. And yet, it was the project manager that was under suspicion from what appeared to be a cosy relationship with the contractor, not the head of security. What also became clear when looking at bribery, when it comes to shares and dividends, they can be given before a contract is signed, during contract management or after contract completion. In this case… In an attempt to hide the kickback and stave off any bribery allegations that were made against the project manager, he was given his shares 12 months after contract completion.
