A first principle of behavioral ethics and some theories of criminology is that most people are not inherently bad even if they do bad things. I happen to believe in that principle and think its pretty well established empirically, both in common sense and back of the envelope math as to how many unethical things people could do without punishment but don't, and also based on lab and field studies. The bulk of the research suggests that while we are all capable of doing the wrong thing under certain circumstances (even without understanding why we might be doing that thing) and we might even default to that capability in an automatic way, we usually do follow some overarching normative structure that is generally prosocial. That's important because it suggests that while there are tails on both ends of that distribution--one being people that will almost always do good regardless of the circumstances and the other that will almost always do bad--there is a large group in the middle that usually does good but can be swayed by circumstance. So if we can understand what sways that large group and figure out some smart interventions--everything from laws to norms to social influence to switching defaults--we can prevent a lot of wrongdoing. If there is an underlying normative agenda of behavioral ethics, that's probably it--help the mostly good people be better because that's the biggest cohort where the most impact can be made. (And you don't have to worry about the always good people.) But what about that other tail, the bad folks? I tend to think that group is way smaller than most people suggest, especially in the white collar world...but then you come across someone like Jack Abramoff, the notorious lobbyist who went to jail in the early 2000s for fraud. Abramoff was so corrupt that Congress amended a statute based on his actions, not once, but twice. And then he became the first person charged with flouting a law designed just for him. Incredible. Abramoff pleaded guilty but hasn't been sentenced yet. Some of those involved with the scheme are going to trial--the scheme involves crypto, naturally--which has brought Abramoff back into the white collar news. In the end, sometimes people are just bad even if they seem for a time to be mostly good and have learned the lessons behavioral ethics is trying to teach.
