?? A federal judge has issued a nationwide preliminary injunction blocking three provisions of Donald Trump’s anti-DEI executive orders: 1. The provision that directs all executive agencies to terminate “equity-related grants or contracts” (the Termination Provision). 2. The provision that requires federal contractors and grant recipients to certify that they do not “operate any programs promoting DEI that violate any applicable Federal anti-discrimination laws” (the Certification Provision). 3. Part of the provision that directs the Attorney General to “encourage” the private sector to end DEI (the Enforcement Threat Provision). The opinion is 63 pages long, but here are a few key takeaways. First, the court accepted the plaintiffs’ argument that the Termination Provision was likely void for vagueness, because the term “‘equity-related’ grants or contracts” invited arbitrary and discriminatory enforcement and didn’t give sufficient notice to grantees on how to adapt their conduct to avoid termination. Second, the court also accepted the plaintiffs’ argument that the Certification Provision likely violated the First Amendment, because it’s a content-based restriction on the free-speech rights of contractors and grant recipients. Third, the court accepted the plaintiffs’ argument that the Enforcement Threat Provision likely violates the First Amendment, because it threatens enforcement action against organizations for engaging in protected pro-DEI speech. The judge also noted that the Enforcement Threat Provision is likely void for vagueness. The court did not, however, block the Attorney General from preparing the “report” that the executive order calls for, or block the Attorney General from engaging in investigation. Finally, it’s worth emphasizing that this is a *preliminary* injunction. That means the plaintiffs have established (among other things) that they are *likely* to succeed on the merits of the case, but the case remains ongoing. Nonetheless, this is a huge victory for everyone rightly worried about the impact of these vague and bullying orders, especially on federal contractors and grant recipients.
