There has been so much activity in the #DEI space that knowing which path forward is right for your organization is tough.?Companies that were quick to retreat from DEI under the new administration are seeing customer and financial backlash, and a Federal Judge blocked several provisions.?Other aspects still stand today, but many have pending lawsuits. Through our?Risk Assessment Service, we help clients determine the pros, cons, and financial impact of their DEI work, including: - The?business case for your organization?- what benefits have you achieved, are on track to achieve, and what will put them at risk - What elements of the Executive Orders impact you based on your?dependence on federal contracts and grants?(first tier) or on clients and state or local entities who depend on federal money (second tier) - What aspects of the Executive Orders impact you based on your current programming and policies,?and how to pivot to stay in compliance while meeting your organizational goals and the needs of your employees - How effective your communications are, both internally and externally, in managing expectations with employees, partners, clients, and customers during this time of flux - The?likelihood of being investigated?based on the Executive Orders, and how can you prepare for that proactively Our Assessment can be a great way to?develop a clear plan?and?build confidence across your Executive Team and Board?that you have the current issues well in hand. • The Trump Administration's Executive Orders surrounding #Diversity, #Equity, and #Inclusion have caused significant chaos and confusion for so many organizations. We're back with a new episode of Your DEI Minute?, The Equity At Work? podcast, and Michelle Bogan is breaking down what the #ExecutiveOrders around DEI actually mean and what different kinds of organizations should and shouldn't be doing to maintain a robust #DEI strategy that is 100% legally compliant. Here's a sneak peek and you can find us wherever you listen to podcasts. https://lnkd.in/gma_DdrT #DEIPodcast #Podcast #DEIExecutiveOrders #TrumpExecutiveOrders

Executive Director, Meltzer Center for Diversity, Inclusion, and Belonging; co-author of SAY THE RIGHT THING: How to Talk About Identity, Diversity, and Justice (Simon & Schuster, 2023)

?? A federal judge has issued a nationwide preliminary injunction blocking three provisions of Donald Trump’s anti-DEI executive orders: 1. The provision that directs all executive agencies to terminate “equity-related grants or contracts” (the Termination Provision). 2. The provision that requires federal contractors and grant recipients to certify that they do not “operate any programs promoting DEI that violate any applicable Federal anti-discrimination laws” (the Certification Provision). 3. Part of the provision that directs the Attorney General to “encourage” the private sector to end DEI (the Enforcement Threat Provision). The opinion is 63 pages long, but here are a few key takeaways. First, the court accepted the plaintiffs’ argument that the Termination Provision was likely void for vagueness, because the term “‘equity-related’ grants or contracts” invited arbitrary and discriminatory enforcement and didn’t give sufficient notice to grantees on how to adapt their conduct to avoid termination. Second, the court also accepted the plaintiffs’ argument that the Certification Provision likely violated the First Amendment, because it’s a content-based restriction on the free-speech rights of contractors and grant recipients. Third, the court accepted the plaintiffs’ argument that the Enforcement Threat Provision likely violates the First Amendment, because it threatens enforcement action against organizations for engaging in protected pro-DEI speech. The judge also noted that the Enforcement Threat Provision is likely void for vagueness. The court did not, however, block the Attorney General from preparing the “report” that the executive order calls for, or block the Attorney General from engaging in investigation. Finally, it’s worth emphasizing that this is a *preliminary* injunction. That means the plaintiffs have established (among other things) that they are *likely* to succeed on the merits of the case, but the case remains ongoing. Nonetheless, this is a huge victory for everyone rightly worried about the impact of these vague and bullying orders, especially on federal contractors and grant recipients. Thank you to Democracy Forward for your advocacy! https://lnkd.in/g-RWA8ex
