I'm hearing from Contracting Officers at several agencies that (allegedly) they can no longer sign contracts without express permission from the highest on high. They are also (allegedly) being told to tell contractors who are due payments for outstanding invoices on terminated contracts to file a claim. Then, (allegedly), the same is happening with some declined orders made with the purchase card. Contractors are reporting declined charges when running cards when readying products for shipment and Federal attorneys at agencies are allegedly also saying while they know it's wrong, businesses must file a claim to get reimbursed. Luckily these vendors have for the most part been able to get paid after some discussion or letters from attorneys. Contracting Officers are also (allegedly) not being afforded legal sufficiency reviews from agency counsel prior to signing termination actions. My advice for COs (and contractors too, as applicable) is to consider documenting-- ?? who gives you the termination order, ?? any written or verbal instructions related to termination procedures or authorities to be used and from whom, ?? your request for a legal sufficiency determination by legal counsel and if it was obtained or denied and by whom (For COs.) ?? a record of any responses by the contractor related to outstanding payments due, ?? any direct reply to contractor inquiries and from whom, and ?? an MFR summarizing the actions you were directed to take against your professional judgment or in violation (if applicable) of any unchanged standing agency policy or processes. (For COs.) Short of a contractual deficiency, labor violation, or system deficiency on the behalf of the contractor, the Government must pay a contractor when the contractor's contractual obligations have been met to receive payment; inspection and acceptance has been made by the Government. The Government must typically provide a written notice to the contractor before withholding any payment, explaining the reason for the action and the steps necessary to resolve the Government's concerns. I'm not convinced this notification is happening because of the numbers of moving parts in what is going on right now and employee departures.
