Empact had an insightful and productive two days in Houston at the Tax Credits & Transferability 2024: Optimizing Post-IRA Opportunities Summit. Our table was alive with meetings and discussions, thank you to all who stopped by! Some key takeaways for the Empact Team were: ? There is real and acknowledged "transactional liability risk" in this market. ? Strong demand for tax credits as more and more corporates and Fortune 500 companies come into the market, but they are deeply risk-averse. ? Deep need for streamlined, standardized documentation and reporting for participants on all sides of these transactions, for projects both small and large. The market is seeking certainty. On day two, our CEO, Charles Dauber, presented From the Conference Room to the Trenches: Real World Lessons in ITC Tax Project Compliance. He shared insights and data from a real-time development project and the risks around PWA, Domestic Content, and Energy Communities compliance. The punch line - the project would've failed an IRS recapture audit, and the costs would've been in the millions. 30% of the project's total capital cost would've been at risk for recapture had they not used Empact's solution. Five weeks out from construction, it's crucial to keep up the momentum! Ensure that your EPC and contractor onboarding is on schedule, and remember to gather domestic content data through the Empact platform. This is also a great time to set up the project's developer and EPC as users in Empact software. We also use this time to verify contractor onboarding is on track: verifying plans for meeting apprenticeship goals, evaluating payroll systems, and working through their labor classifications and wage rates to ensure labor classifications are correct.
