CLIENT ALERT: On March 19, the U.S. Equal Employment Opportunity Commission (“EEOCâ€) and Department of Justice (“DOJâ€) issued two new technical assistance documents addressing Diversity, Equity, and Inclusion (“DEIâ€) actions and programs in the workplace. The guidance characterizes various kinds of DEI-related initiatives as potential violations of Title VII of the Civil Rights Act of 1964 (“Title VIIâ€) and is framed as advice to employees who may have experienced “DEI-related discrimination†in the workplace. The publication of the EEOC and DOJ guidance does not necessitate the dismantling of DEI programming by employers, although it highlights the administration’s view that DEI initiatives are fundamentally suspect and often serve as a vehicle for conduct prohibited under Title VII. This morning, the White House issued a Presidential Memorandum titled “Preventing Abuses of the Legal System and the Federal Court.†Elias Law Group Chair Marc Elias issued the following statement in response: “President Trump is attempting to dismantle the constitution and attack the rule of law in his obsessive pursuit of retribution against his political opponents. Today’s White House Memo targets not only me and my law firm, but every attorney and law firm who dares to challenge his assault on the rule of law. “President Trump’s goal is clear. He wants lawyers and law firms to capitulate and cower until there is no one left to oppose his Administration in court. “Elias Law Group will not be deterred from fighting for democracy in court. There will be no negotiation with this White House about the clients we represent or the lawsuits we bring on their behalf. “Our democracy is in peril, and the decisions made by lawyers and their firms may very well determine the future of the rule of law in the United States.â€
