The FAMLI program will ensure all Colorado workers have access to paid leave in order to take care of themselves or their family during life circumstances that pull them away from their jobs — like growing their family or taking care of a loved one with a serious health condition. FAMLI will start providing benefits to employees beginning January 1, 2024.

Employees can’t be required to use employer-provided PTO or sick leave before or during FAMLI leave, but they may choose to do so. Employers and employees must have a written agreement to use accrued PTO and sick leave to top-off the employee’s FAMLI benefit payment. The total amount paid from PTO, sick leave, and FAMLI may not exceed the employee’s average weekly wage. If an employee is improperly paid PTO or sick leave, employers may recoup the overpayment. ?? Employers ?? Your employee headcount will be calculated once a year. Employers are required to update their employee headcount in My FAMLI+ Employer every year by February 28. If your Annual Total Employee headcount is not updated by February 28, the FAMLI Division will assume you have 10 or more employees, and you’ll be required to send in 0.9% of wages each quarter of that year.
