Each year the firm designates a charity to receive a portion of the proceeds raised from the group’s March Madness entries. ???? Winner Winner Chicken Dinner Alert ???? We are pleased to share a significant appellate victory in Liberty Mutual Insurance Co. v. Lee, where the Sixth District Court of Appeal in Florida reversed a trial court’s decision that improperly limited Liberty Mutual’s lien recovery. The ruling clarifies that under Florida’s workers’ compensation law, a carrier’s equitable distribution must be based on all benefits paid—not just those paid up to the date of settlement. This case centered on whether Liberty Mutual Insurance could recover its pro-rata share of over $300,000 in benefits paid after the settlement date but before the equitable distribution order. The trial court's approach excluded these payments, creating a potential windfall for the claimant. The Sixth DCA corrected this error, reinforcing that workers’ compensation carriers are entitled to equitable reimbursement for all benefits paid under Florida Statute §440.39(3)(a).
