Should major law firms do more to protect the rule of law? In various parts of the world, this fundamental value—that thing that tells us we're all subject to laws and that no one person or entity is above the law—is being chipped away at. Donald Trump is laying the groundwork for a Presidency that promises to strip away at the establishment; the International Criminal Court issued an arrest warrant for Israel's Prime Minister Benjamin Netanyahu for alleged war crimes in Gaza; lawyers and activists in Hong Kong were jailed following pro-democracy protests. But, beyond a few glib words tucked away in corners of their websites, corporate law firms are generally pretty quiet on the rule of law. Stories from the past year alone suggest that Big Law is more happy to test the limits of the concept: - participating in, and profiting from, the shadowy world of political lobbying - assisting regimes in covering up woeful human rights records - helping multinationals swerve justice in poorer nations (See example stories in the comments) Is that shortsighted? What are the consequences of acting for clients or taking on mandates that might generate revenue but could in the long term serve to erode the rule of law? Law firms deal in uncertainty. In Henry County, a state court jury returned an $83 million automotive tort verdict against Progressive, which earlier rejected a $100,000 policy limits demand. "The only reason the verdict and judgment exist is because Progressive refused multiple reasonable offers of compromise," said plaintiff attorney Ben Brodhead.
