Understanding the new Maryland Online Data Privacy Act of 2024 The Maryland legislature has passed the Maryland Online Data Privacy Act of 2024 (MODPA), which imposes stringent data privacy mandates including data minimization and protecting minors' data. It applies broadly to entities handling significant amounts of personal data within Maryland. MODPA emphasizes consumer rights, such as the correction, deletion, and access to personal data. There's a specific prohibition on the sale of sensitive data and strict privacy notice requirements. The Act will become effective in October 2025, with full applicability from April 2026. Colorado: Neural data is sensitive data The Colorado General Assembly has passed House Bill 24-1058, which now awaits signature by Colorado Governor Jared Polis. The bill would amend the Colorado Privacy Act (CPA) to expand the definition of "sensitive data" to include: "'Neural data', which is information that is generated by the measurement of the activity of an individual's central or peripheral nervous systems and that can be processed by or with the assistance of a device." Companies fall short on curbing cybersecurity risks from vendors: Moody’s Rising premiums have not reduced demand for cybersecurity insurance, according to Moody’s. Cyberattacks annually surged 26% on average from 2017 until 2023, the rating firm said, citing University of Maryland data. “This number is likely to be understated since organizations are often not required to report cyberattacks,” according to Moody’s. https://lnkd.in/eNuvM7C7

Target hit with class-action lawsuit claiming it violated Illinois' biometric privacy law. The suit intends to seek $5,000 for "each and every intentional reckless violation" of the law, or statuary damages of $1,000 for any violation found to have been committed negligently. It also intends to collect attorneys fees and other litigation expenses. According to the suit, Target's "advanced system of electronic surveillance" includes operating 14 investigation centers as well as two forensic labs to "enhance video footage and analyze finger prints." While intending to detect shoplifters, the system also captures customers faces every time they enter or leave the property, the suit alleges. https://lnkd.in/eykBmZuU
