EPR for packaging is gaining momentum across the U.S., with multiple states in the thick of rule making, implementation, and compliance planning. As policies take shape, brands, manufacturers, and stakeholders must stay ahead of critical deadlines and shifting regulations. Here’s what you need to know right now: ?? Oregon: The nation’s first producer reporting deadline is fast approaching! By March 31, producers of packaging, paper, and food service ware must submit 2024 supply data through Circular Action Alliance’s portal. ?? California: Gov. Newsom has directed CalRecycle to restart the SB 54 rulemaking process due to cost concerns, delaying the state’s packaging EPR regulations. The agency has one year to develop and adopt new rules. ?? Maryland: After passing a packaging EPR “study bill” in 2023, the state has released a recycling needs assessment and policy recommendations, setting the stage for future legislation. ?? Minnesota: The state confirmed Circular Action Alliance (CAA) as its Producer Responsibility Organization (PRO) under the Packaging Waste and Cost Reduction Act. ?? Staying on Top of EPR Deadlines: What You Need to Know Extended Producer Responsibility (EPR) for packaging is gaining momentum across the U.S. with several states passing new legislation. Now, we’re entering the critical phase of rule making, implementation, and compliance. Keeping up with these evolving timelines is no small task. We’ve rounded up key updates and upcoming milestones for EPR implementation in California, Colorado, Maine, Minnesota, and Oregon. Here’s a snapshot: ?? California: The state will begin publishing covered material recycling rates and reviewing PRO plans by 2026, following the pending promulgation of regulations in 2025. ?? Colorado: Circular Action Alliance submitted its initial plan for review by the Producer Responsibility Advisory Board. ?? Maine: The state’s Department of Environmental Protection will issue a request for proposals (RFP). ?? Minnesota: The MPCA has named an 18-member advisory board to guide its packaging EPR program. ?? 96 million tons. That’s the staggering amount of packaging waste generated annually in the U.S., but only 39% of it is recycled. Let’s break it down: ?? Paper: 42.M tons generated, 30% recycled. ?? Cardboard: 34.2M tons generated, 54% recycled. ?? Glass: 9.9M tons generated, 41% recycled. ?? Aluminum: 1.5M tons generated, 37% recycled. ?? PET bottles: 3.3M tons generated, just 23% recycled. It would take an estimated investment of $22-28 billion in recycling infrastructure for the U.S. to recycle an additional 38-45 million tons, raising the national recycling rate to 45-47%, closer to the EPA’s 50% goal. However, challenges persist: ?? 40% of households lack access to equivalent recycling services. Implementing a nationwide glass separation program could cost $3 billion. ?? 80% of states don’t have deposit programs to incentivize recycling.
