No conflicts—OpenAI’s adorable purple character is 100% original, and the authorship of OpenAI has already been established. However, it would be nice to register it with some help from CopySight and the US Copyright Office to own the character. A pretty big announcement... It’s been an absolutely wild ride building Metaphysic.ai with my co-founders and our extraordinary team. Being in the publishing business is already really hard and AI platforms scraping their content is absolutely an existential threat. Conde Nest struck a licensing deal with OpenAI last year and this will be the way forward in order for AI platforms and publishers to live in peaceful co-existence - the alternative is legal battles and we will likely see a rising amount of those in the next year or two.

The creator didn’t just prompt an AI; they selected, coordinated, and arranged 31 elements using inpainting—AND recorded the process on video. That was enough to convince the Copyright Office. Why does this matter? ?? It’s a major shift in the AI copyright debate. ?? It sets a precedent—AI-assisted art can be copyrighted if human creativity is provable. ?? It strengthens cases like Jason Allen’s, which was previously denied protection. This isn’t the end of the fight—courts still need to weigh in on prompt-engineered works. U.S. Copyright Office (finally) registers a single AI-generated image aptly titled "A Single Piece of American Cheese" ?? by the company Invoke AI. How? Based on the human creator's "selection, coordination, or arrangement" of 31 elements via inpainting, a process the author recorded on video! Authorship based on selection and arrangement. Copyright 101. See Feist. Feeling slightly vindicated ?? ?? after devoting nearly 2 years to show why the Copyright Office's initial position was wrong. This is a welcome step in the right direction. A little validation feels good… Earlier today the US Copyright Office released its long-awaited report on the copyrightability of AI-generated works.?The bottom line is that human control over the creative process remains key to copyright protection.?And it observes that today’s generative AI models, even with detailed prompts, typically make too many independent decisions to qualify.
