Is “Forced Software” in Construction Legal? When GCs require subcontractors to use—and pay for—their software platforms, it’s always rubbed me the wrong way. It’s a model that’s become too common in construction tech. And while it’s efficient for platforms and GCs, it raises real questions about fairness, leverage, and legality. A recent post from Kevin Ferguson about his family’s business having to pay for a prequal platform finally pushed me to dust off my old construction law blog and dig into the legal side of this.
