STIHL wins appeal against the Bundeskartellamt's infringement decision on its non-compete covenant. ?? CASE SITUATION: STIHL distributes its products in Germany through specialized dealers. In May 2022, the FCO ruled that an exclusive dealing clause in contracts with some dealers foreclosed competing manufacturers. ?? OUR ROLE: Compass Lexecon’s analysis confirmed that STIHL’s competitors had alternative outlets across Germany. Our econometric analysis showed the exclusive dealing clause likely had no impact on demand for competitors' products. ?? OUTCOME: In August 2024, the Düsseldorf Higher Regional Court overruled theFCO decision, finding that the authority’s analysis had failed to prove that the clause was anticompetitive by effect or by object.
