Compass Lexecon’s client, the City of Baltimore, was awarded over $260 million in damages after a jury ruled that the distribution practices of several pharmaceutical companies substantially contributed to the public nuisance created by the misuse of prescription opioids. We supported the City of Baltimore’s expert, Professor Brendan Saloner, who used detailed statistical analysis to quantify the relationship between misuse of prescription opioids and the development of opioid use disorder. A federal judge ruled in favor of our client, the Federal Trade Commission in granting a preliminary injunction to pause the proposed merger of Tapestry and Capri. The judge relied heavily on Compass Lexecon expert Dr. Loren Smith, who testified at the hearing that the proposed merger would substantially lessen competition in the market for accessible luxury handbags.
