The Community Home Lenders of America (CHLA) is a national non-profit association of small and mid-sized community-based mortgage lenders. The mission of the CHLA is to promote federal mortgage programs, rules, and regulations which treat community mortgage lenders fairly, and which reflect the critical importance that community mortgage lenders play in providing broad access to credit for borrowers, in increasing competition in mortgage markets, and in providing borrowers with quality mortgage services and access to loans at a local level. Community mortgage lenders face both significant challenges and new growth opportunities as the landscape for mortgage lending and servicing continues to change at an unprecedented rate. Federal agencies are issuing a number of new regulations under Dodd-Frank, the CFPB continues to grow, and Congress is beginning a vigorous debate on the financial status and role of FHA, on the future of Fannie Mae and Freddie Mac, and on steps that could be taken to bring private capital back into mortgage markets, in order to shrink the footprint of Fannie, Freddie, and FHA. These changes could have a major impact on community mortgage lenders. CHLA commends HUD's decision to delay the enforcement of the International Energy Conservation Code (IECC) standards for FHA-financed new homes by six months. CHLA had previously advocated against this federal intervention into local construction standards, expressing concerns that it could restrict FHA loan access for many prospective homebuyers. Independent Mortgage Banks (IMBs) play a critical role in homeownership, yet they face duplicative and costly regulations that impact efficiency and affordability. The Community Home Lenders of America (CHLA) has taken action—writing to the CFPB with key recommendations to streamline oversight while maintaining consumer protections. ? The CFPB should exempt smaller IMBs from exams, pursuant to the Dodd-Frank statutory requirement to tier supervision by firm size, volume, and risk – and limit exams of larger IMBs to gaps in state exam schedules or to state requests for the CFPB to conduct an exam. ? The CFPB should end regulation by enforcement, a practice that disproportionately harms smaller IMBs and their borrowers. Moreover, CFPB fines and orders should be based on the severity of the violation and should be clearly defined and be of finite term. ? The CFPB should increase LO Comp Rule flexibility – to help consumers by increasing competition and removing impediments to State HFA bond loans and IMB brokered loans. ? The CFPB should immediately suspend court order registry requirements for IMBs and withdraw its proposed form contracts rule. Both are redundant and unnecessary for IMBs.
