The fate of the new climate disclosure rule adopted by the SEC in March is uncertain given the recent presidential election. Climate disclosure will continue with or without the SEC, making this a crucial period for the agency to grapple with its future role in the climate disclosure space. New analysis by Andrew Bernstein, Cynthia Hanawalt, Lisa Sachs, and Chloe Field explores novel questions of implementation and enforcement that the SEC will likely face in coming months, offering a framework and analysis to ground these questions as a new context for climate issues emerges in the United States.
