Volunteers with the Colorado Lawyers Committee Election Task Force secured a big win on appeal in a voting rights case this week on behalf of the League of Women Voters of Weld County, the Latino Coalition of Weld County, and two Weld County voters and against the Weld County Board of County Commissioners. The Colorado Supreme Court affirmed the trial court’s recognition of a private cause of action under the county anti-gerrymandering statute and that the County had failed in nearly every respect to comply with the due process requirements of the statute and directed the County to complete redistricting in time for the 2026 Commissioner Election. This is the first reported decision interpreting the county anti-gerrymandering statute as well as the first decision addressing the scope of county home rule under the Colorado Constitution – a provision which has been in effect for over half a century.
