Bonita Springs Associate Melanie Everett and Partner Ron Campbell recently obtained a complete defense verdict in a Collier County arbitration of a compounding pharmacy negligence case. Plaintiff alleged our client pharmacist breached the standard of care by compounding a prescription in connection with her hormone replacement therapy in a dosage that was excessively high, and failing to warn of risks associated with secondary exposure. Plaintiff alleged that as a result of the pharmacist's negligence, her minor son came in contact with the estradiol resulting in gynecomastia, precocious puberty, and advanced bone age. While the unfortunate condition suffered by the child was real, the arbitrator ruled against Plaintiff on causation. This is a case that presents some interesting issues, including a defense based on the learned intermediary doctrine. The client and carrier are monitoring the case closely, so they are naturally thrilled. Tampa Partner Scott Jackman and Associate Sasha Pandolfo recently obtained a great result in Sarasota following a 4 day jury trial in a condominium association case in which the plaintiff alleged over $1.4 million dollars inclusive of past medical expenses, past pain and suffering, future medical expenses, future pain and suffering, the cost of moving to multiple subsequent units, utilities, furniture, and replacement of all clothes, shoes, and handbags following her "prolonged" exposure to mold in our client's unit. The Plaintiff sued both the property management company and the condominium association for negligence, breach of Florida Statute 718.113, and breach of contract. Between both the association and property management company, our clients offered $200,000.00 to resolve the matter, which was rejected.?? ? After approximately 5 hours of deliberations, the jury awarded the Plaintiff $45,500.00 for property damage, living expenses, and past pain and suffering while awarding nothing for past or future medical expenses, nothing for future pain and suffering, and no finding of permanency. The jury also determined that the Plaintiff was negligent in the maintenance of her unit which also contributed to her mold exposure. Miami Partners Sarah Egan and Mike Brand recently obtained a great result in a Miami trial against a national plaintiff firm. In an admitted liability case, which included $62k in past meds, $215k in future meds, a recommendation for future cervical fusion and plaintiff's vehicle totaled and towed from the accident scene, plaintiff's counsel asked the jury for a total award of $1.9 million. The jury, after two hours of deliberation, awarded the plaintiff precisely $5k in past meds, finding no permanency, no future meds and no pain and suffering.?Additionally, the defense will collect on their expired $90k PFS. Miami Partners, George Truitt and Anthony Lopez, and Miami Associate, Andrea Faverio, secured a significant victory in a complex construction dispute in Miami-Dade County. ? ? Plaintiff, the owner of an exclusive mix of Class A office space and a showroom gallery in Miami's Design District, sought $15 million in consequential damages. CSK represents the General Contractor who took over the beleaguered project after the first elevated slab had been poured. The Developer-Landlord claimed large exterior terraces were inadequately waterproofed, causing water intrusion into the tenants' spaces and the stucco system was poorly installed on the concrete substructures. The Court granted our Motion for Partial Summary Judgment, finding that the prime construction contract contained a clear and unambiguous waiver of such claims. Although Plaintiff argued that a narrow exception in the contract's addendum should apply—allowing recovery if the insurance policy covered consequential damages—the Court determined that the policies did not extend such coverage. Additionally, Plaintiff's attempt to recover under a separate repair protocol agreement was rejected, as the Court found that the terms of the prime contract and addendum were incorporated into that agreement. The Court also dismissed Plaintiff's evidence in support of their claims as inadmissible hearsay and concluded that the remaining admissible evidence did not create a genuine issue of material fact. ? In a thorough, two-day hearing, the Court carefully considered Plaintiff's multiple briefs and ultimately ruled in our client's favor. This ruling effectively reduced the Plaintiff's claims by $15 million, highlighting the strength of our arguments and led to a favorable settlement and resolution of the case. During my time at CSK, I have appreciated the camaraderie among my colleagues and gained invaluable experience managing cases from the pre-suit phase through trial. In a short time, I have had the opportunity to communicate directly with clients, depose witnesses, conduct mediations, and serve as second chair during trials. Born and raised in Miami, Florida, I earned my undergraduate degree from Florida State University (Go Noles!) and my law degree from Florida International University School of Law.
