  • Earlier this week, SCOTUS issued a landmark opinion on the Napue doctrine in granting a new trial to death row inmate Richard Glossip. Going forward, as CW partner Alyssa Bell highlights, the Glossip decision should serve as a roadmap for criminal law practitioners litigating Napue claims. Of particular note, Glossip makes clear that a lie on the stand carries particular weight; even a thoroughly impeached witness will lose credibility with the jury. Glossip also explains that the requisite prejudice analysis requires a “cumulative evaluation” of all the evidence—not only the Napue error, but any other conduct that undermines confidence in the verdict.

He also served as one of the lead trial lawyers for Fox Corp. and Fox News Network in what The New York Times called “the libel law equivalent of the Super Bowl”: a multibillion-dollar litigation brought against Fox by Dominion Voting Systems.
