Earlier this week, SCOTUS issued a landmark opinion on the Napue doctrine in granting a new trial to death row inmate Richard Glossip. Going forward, as CW partner Alyssa Bell highlights, the Glossip decision should serve as a roadmap for criminal law practitioners litigating Napue claims. Of particular note, Glossip makes clear that a lie on the stand carries particular weight; even a thoroughly impeached witness will lose credibility with the jury. Glossip also explains that the requisite prejudice analysis requires a “cumulative evaluation” of all the evidence—not only the Napue error, but any other conduct that undermines confidence in the verdict.

CW has a history of successfully representing students and employees implicated in Title IX and other disciplinary proceedings.?Recently, we obtained a full resolution for a university employee who was charged with multiple Title IX violations. After our team raised numerous procedural objections and defended the client at an evidentiary hearing, he was cleared of all wrongdoing by the university.
