Our Managing Director, Sarah Peterson, recently spoke with The Tech Capital about from the recent Critical National Infrastructure designation given to data centers by the UK government.?While there may be benefits to the industry, she also says there may be a few challenges as well. ? ?? During her time as a lobbyist in Washington D.C. she witnessed industries that received “special recognition” often resulted in less operational independence. ? ?? Will the #CNI push to standardize in order to improve the ability for the UK Govt to support and protect data centers, which could effect operators flexibility in site selection and grid interconnect? ? ?? Will all data centers be given the same privileges under the CNI or will the UK Govt institute some vetting process that results in a hierarchy among data centers? ? ?? Could this process may be requiring data center operators to share privileged information about their customers in order to justify their status??Will refusing to share may disqualify operators from participating? ? ?? Most importantly, she urges the industry to rethink the current narrative with policy makers globally to become more transparent and collaborative in their approach. Texas Data Centers, we have a problem. “Regulations come from market failure.” - John Booth MBCS, CDCAP, CDCSP Booth, @Datacloud Iceland 2024.??Here’s the reality market failure is coming.??There is no question that the demand for data centers appears to have no end in sight. Just ask any Data Center attorney they can’t keep up with the current workload. So where is the market failure coming from???The lack of power infrastructure and the unwillingness of utilities and states to bear the cost to support these booming data centers.??ERCOT president and CEO Pablo Vegas stunned members of the Texas Senate Business and Commerce Committee when he testified in a hearing on June 12, 2024 that the rising demand coming onto the grid from AI data centers and crypto mining requires the Texas power grid to increase its overall capacity from 85,000 MW to 110,000 MW over the next six years.? Shortly after the hearing Office of the Texas Lieutenant Governor Dan Patrick posted on X that both the crypto miners and data centers need to be closely examined. "I’m more interested in building the grid to service customers in their homes, apartments, and normal businesses and keeping costs as low as possible for them instead of for very niche industries that have massive power demands and produce few jobs." As an industry, ? we need to engage at the national and state level with policy makers to ensure that we don’t become a regulated utility.?? ? We need to set the tone of the conversation by educating our policy makers.?? ? This is bigger than just help with zoning issues and has nothing to do with perception. No one should be surprised or concerned by this. The overturning or complete rejection of the SEC Climate Disclosure Rule is only delaying the inevitable for U.S. businesses – climate change regulations are coming. What policymakers and companies in the US have yet to realize is that the SEC regulation on sustainability is largely a moot point.??The far-reaching effects of the EU’s CS3D will require any company wanting to participate in the EU or with a company that operates in the EU to comply with regulations far more stringent than envisioned by the SEC.?? The European Parliament has finally voted to adopt the Corporate Sustainability Due Diligence Directive (CS3D).? ? The legal ramifications of this Directive cannot be underestimated.?The CS3D stands at the precipice of creating a new form of enterprise liability called production liability.? ? This Directive holds companies liable for the actions of those in their chain of activity.?The idea of linking multiple corporate entities into one connected body challenges the traditional concepts of contract & tort law.? ? It is a mistake for companies to assume they will not be held to CS3D standards because they do not meet the criteria.?If there is a company that falls under the auspices of the CS3D, then every company in the upstream value chain will be held to those same standards. ? Most in house and legal counsels are focused only on ensuring compliance with this new Directive, but are failing to focus on a much bigger undefined area that is going to have a major impact on the language contained in their legal agreements. ?
