Theory is a powerful predictor of the future. Last week, Forward announced its closure, effective immediately. Last December, after their Series E round, I wrote a piece (linked below) evaluating the launch of their "Carepods," which Forward claimed would be the world's first AI doctor's office. In brief, I assessed that Forward's plans for the future seemed grounded only in leaders' vision for the ideal world, and not in consumers' desires for progress, a.k.a. their #JobstoBeDone (JTBD). Therefore, theory would predict Forward was competing against luck and unlikely to succeed in the way they envisioned. Theory was right. How can you leverage it? In higher education, the debate over the 2011 Dear Colleague Letter has raised questions about the stability of revenue-sharing agreements between universities and OPMs. Michael Horn takes a closer look to reveal a strong and consistent foundation: - Regulatory interpretations date back to the 1990s. - Legislative history underscores Congressional intent to permit bundled services exceptions. - Courts uphold agency interpretations through Skidmore deference.
