Law Enforcement & Financial Crimes Professionals: Beware of Bust-Out Auto Fraud In recent years, there has been a noticeable increase in high-end vehicles on the streets being rented/ sub-leased... often times with no liens, as well as dealers struggling to report fraudulently obtained vehicles as stolen, almost always being told it is a?civil matter.?Many of these cases however, are part of a much larger?criminal enterprise. A recent article posted by Scott Ellefson, highlights a?multi-million-dollar bust-out fraud ring in Miami dubbed the "South Beach Bust Out Syndicate", where fraudsters are using straw purchasers coupled with synthetic identities, fake financial/ employment records, etc. to fraudulently acquire exotic/ luxury vehicles. Once these vehicles leave the dealership lots, they are quickly monetized via a variety of schemes. Some are quickly sold & exported overseas, some are subleased using online rental platforms or social media sites such as Instagram & FB Marketplace, and others are "lien stripped" using fraudulent lien releases or storage/mechanic/ body shop liens. Regardless of how they are monetized however, they are ultimately used to facilitate further criminal activity. What Law Enforcement Needs to Know: - These vehicles often appear “clean” with no liens.?In some cases however, they have an active lien holder, but the fraudsters are not making payments. It is important to note that the fraudsters never intended to make any payments from the time they were fraudulently purchased because they know that the lenders will only be able to try to repossess the vehicles since law enforcement views this as a civil matter. In other cases, criminals manipulate the system through?“lien strips” or lien removal fraud, effectively erasing lender interests before flipping the vehicles. - Dealers and lenders struggle to report them as stolen.?Fraudulent financing schemes complicate traditional theft classifications, leading many cases to be dismissed as civil disputes. This is especially true when a road patrol officer/ deputy responds to a call for service & they do not have sufficient training and experience to identify the overall larger scheme to defraud. - Many of these vehicles are tied to larger criminal organizations.?They are being used in street crimes, drug/human trafficking, and even being exported overseas. ???? $85,000 - FRAUD RENTAL - 2024 BMW X7 - TRACKED DOWN, LOCATED & RECOVERED W/KEYS ? We were recently assigned a case involving a 2024 BMW X7, valued at $85,000, that was rented through a fraudulent account takeover and stolen identity. This vehicle was likely targeted to be re-VIN'd, and without quick action, it would have resulted in a total loss payout. Fortunately, we quickly located and secured the vehicle for a fast recovery. ???? $200,000 - STOLEN - 2021 LAMBO URUS - LOCATED & RECOVERED ? This vehicle was referred to us by our client after the lessee claimed that it was stolen by OUR CLIENT. Yes, you read that correctly, the lessee hired an attorney and alleged that our client stole the vehicle from him. Clearly that wasn’t the case and we were brought in to track down the vehicle and get the situation resolved. After a little digging, we discovered that while the lessee hired an attorney to go after our client alleging that they stole the vehicle from him, he also filed a stolen vehicle report with his local police department over a month before he made this allegation. Long story short here, the lessee basically filed a fraudulent stolen vehicle report, sent a cease & desist letter to our client from his attorney based on a complete lie, AND we discovered that he actually sold the vehicle to an unsuspecting buyer in another state and provided his DL & accepted a wire as payment! We ultimately tracked the vehicle down in Idaho of all places and had the vehicle safely recovered. The vehicle has since been returned to our client and the lessee has some explaining to do!
