The perfect way to start the weekend - a hike with Ciarb (EAB) YMG along Aberdeen Reservoir followed by yum cha at MTR Corporation Limited 香港鐵路有限公司's brand new mall The Southside adjacent to Wong Chuk Hang Station. Along the way we unexpectedly encountered a large family of wild boar, an unpredictable species capable of disrupting environments and a not infrequent sight along Hong Kong hiking trails. I would like to share that my latest article, co-authored with the accomplished Serap Müftüo?lu LL.M., from Turkey, has been published in the Winter 2024 edition of The Resolver, CIArb's magazine, on pages 20–22. This case note analyzes the landmark UK Supreme Court decision in UniCredit Bank GmbH v RusChemAlliance LLC, which reaffirmed the principle of party autonomy amidst complex geopolitical tensions. The case explores how English courts uphold arbitration agreements, even when faced with parallel proceedings in foreign jurisdictions, such as those arising under Russia’s local laws on sanctions-related disputes. Together, Serap and I examine the court's approach to balancing contractual commitments against international political pressures, offering key takeaways for practitioners navigating arbitration clauses in cross-border contracts.
