In a recent thought piece – “One Fix CMS Can Make to the IRA Right Now” – Jaden Jackson and Rich Bagger of Christie 55 Solutions emphasize a significant flaw in the Inflation Reduction Act’s Medicare drug price “negotiation” program that CMS can remedy without delay. If CMS imposes price controls on innovator drugs near to or in some cases after they lose exclusivity, it would discourage the launch of low-cost generics, hurting competition, and increasing long-term costs. A simple fix: CMS should exclude from the price setting process drugs that are near their loss of exclusivity date. This small change can preserve the Hatch-Waxman framework and ensure patients continue to benefit from robust generic competition after the innovators’ patents expire.
