The doctrine of abuse of rights serves as a critical safeguard in investment arbitration, ensuring that the arbitration process is not triggered for inappropriate purposes. More particularly, it protects against the use of tactics in Investment Arbitrations that could lead to undue delays in the arbitration process, as such delays could frustrate the timely enforcement of rights of the parties involved. Further, the doctrine of abuse of rights promotes an environment of equity and justice, ensuring that arbitration serves its intended purpose of resolving disputes efficiently and fairly. It also ensures that arbitration is not misused for purposes such as harassment, undue delay or obtaining unjust advantages. To establish that an abuse of rights has occurred, it is required that an investor exercise a right under a treaty. Then, that right that was exercised must have been exercised in bad faith or for an improper purpose. It must also be established that the right exercised under the treaty has caused harm to the state. In all cases, the timing of the investment and the reasonableness of the investor’s actions are critical factors that an arbitral tribunal considers in making a determination that there has been an abuse of rights. #wat #ciarb #ciarbghanachapter
