Prior to the start of Nevada's 83rd Legislative Session, the Chamber announced its four legislative focuses as part of its Innovation Lab series, one of which was to consolidate agent card categories. As such, we encourage industry stakeholders to consider testifying in support of Assembly Bill 308 at its first committee hearing this TUESDAY, March 11th at 8:00 am. The Chamber is thrilled to support Assembly Bill 308 from Assembly Member Backus! If passed, AB 308 will eliminate the costly practice of requiring a separate agent card for each type of cannabis establishment. This current practice discourages cross-training and limits the size of the industry's talent pool. Like Arizona's industry, AB 308 establishes one agent card type for independent testing labs and a second for ALL other establishment types. The best part? As introduced, the application and renewal fee will remain at $150 for 95% of the 14.5k registered agent card holders in Nevada. Hearings for Senate Bill 157 and Senate Bill 168 are taking place @ 8am THIS WEDNESDAY, Mar. 5th?? ??Senate Bill 157 revises provisions related to cannabis testing regulations and independent testing labs. As introduced, the bill introduces statutes for lot sizes and proposes quantities that are 10x greater than those currently in regulation. ??Senate Bill 168 addresses the CCB's issuance of hold orders, promoting consistency and timeliness while protecting public safety. SB 168 also proposes increased limits for single packages. These hearings will occur in the Senate Commerce & Labor Committee, the first committee in the house of origin for both bills. Historically, Nevada's definition of a “lot” and quantities for testing have been exclusively determined by regulation and are currently defined in NCCR 1.125 ?? If passed, Senate Bill 157 will introduce a statutory definition that includes a 10x increase (??) in lot sizes across categories ?? With these increases, SB 157 introduces a sliding scale for the required number of representative samples of flower to be collected based on the weight of the lot ?? > 10 lbs = 8+ samples 10 lbs - 20 lbs = 12+ samples 20 lbs - 30 lbs = 15+ samples 30 lbs - 40 lbs = 18+ samples 40 lbs - 50 lbs = 19+ samples The bill is currently pending its first hearing in the Senate Committee on Commerce and Labor. In November 2024, the CCB issued a Public Health and Safety Bulletin about products from a cultivation facility due to the unauthorized use of pesticides – this was issued 2+ months after the products were placed on hold in METRC... If the provisions proposed in Senate Bill 168 were already in place, this series of events would have unfolded differently ?? SB 168 requires the Board to adopt regulations about issuing hold orders, including the circumstances justifying a hold order and requiring that notice be provided to those whose product is subject to the hold order. Additionally: ?The hold order automatically terminates after 14 days. ??The Board may only extend the duration of the hold after a hearing and for good cause shown. ??The circumstances for terminating a hold order must include the passing of a retest by a lab. Like Assembly Bill 76, Senate Bill 168 includes increases to single package limits. Since its initial introduction, the CCB intends to amend AB76 to include limits that are identical to those set forth in SB168.
