    You are invited to learn about one of the Center for Art Law's most popular programs: Visual Artists' Legal Clinics. Our Clinics are an inexpensive way for artists and other art market participants to gain insight and advice about specific areas of the law: The Center currently operates four clinics and hosts seven clinic sessions each year. We are pleased to welcome Olivia Taylor (Artist-Dealer Relationships Clinic), Scott Sholder (Art & Copyright Law Clinic), Dave Bright (Artist Legacy and Estate Planning Clinic) and Rebecca Lenetsky (Visual Artists' Immigration Clinic), who will share their experiences in volunteering for the Clinics and outline what future participants can expect from their consultations.     Meet Richard Lehun, the speaker at our "Art & Law Workshop: Fiduciary Duties of Trustees of Estates" event on November 26, 2024 at 12:00 pm EST. This workshop will focus on the fiduciary duties of trustees in managing an artist’s estate, providing a comprehensive overview of key concepts and responsibilities. It will explore the roles of executors and trustees and their legal obligations. The session will cover topics such as the creation and administration of trusts, artist-endowed foundations, and the implications of having or not having a will. Notable case studies, including the Matter of Rothko, will illustrate the potential legal pitfalls in estate management. Additionally, the workshop will provide a practical checklist for estate planning, including how to create an inventory, choose a legal structure, and select appropriate fiduciaries. Richard Lehun is a Founding member of Stropheus, a New York-based legal and business collective for the arts. He is responsible for transactions involving fiduciary duties and conflicts of interest, particularly those relating to artist-gallery relations, artist commissions, art advising, consignor-auction house relations, gallery, museum, auction house, and non-profit ethics. He also works in the area of arts-related intellectual property issues, including copyright and trademark. Richard Lehun completed his JD and then moved directly to the SJD program at McGill University. He gathered practical legal experience with Léger Robic Richard, Montréal's respected intellectual property practitioner. While a teaching fellow at McGill’s law faculty, Richard Lehun was cross-appointed as a Visiting Researcher at Harvard Law School.     Meet the volunteer attorneys at The Center for Art Law's Art & Copyright Law Clinic. The Clinic helps artists navigate the increasingly complex field of copyright law and is scheduled for November 13, 2024, from 5:30 PM to 8:00 PM (EST). Giselle Ayala is an attorney at GAM Law Office PC. Scott Sholder is a partner at Cowan, DeBaets, Abrahams & Sheppard LLP. Olivia Taylor is an associate at Pryor Cashman LLP. In this Clinic, participants will first learn about copyright contracts (licensing and assignment agreements) from attorney and Center for Art Law advisory board member Lindsay Korotkin, who will explain the scope of each agreement and the main concerns artists should keep in mind when negotiating them. Following the presentation, those with consultation tickets will have the opportunity to discuss their specific copyright issues with a US-licensed attorney in private and confidential 20-minute consultations.     On Nov. 13, Lindsay Korotkin will speak at our Art & Copyright Law Clinic. Lindsay Korotkin is a partner at ArentFox Schiff’s Intellectual Property department, where she advises companies and creators in the art, media & entertainment, fashion & retail and technology industries. Lindsay’s practice focuses on copyright, trademark, trade dress, right of publicity, and art market litigation, prosecution, and transactions. Want to take part in the clinic?     Join us on December 5 at 12:00 pm EST, to learn how to secure greater copyright protection for your artwork by registering it with the US Copyright Office! Center for Art Law is proud to host its director and attorney Carol J. Steinberg, Esq., for a workshop on the practical aspects of registering works of visual arts with the US Copyright Office. In this Workshop, Carol will explain why Copyright Registration is a prerequisite for enforcing your legal rights and why she calls it "Artists Liability Insurance." She will explain what it is, how to get it, and specifically what benefits it yields and what losses failure to register can bring. She will provide guidance as to how to navigate the U.S. Copyright Office process with some guidelines for group registrations and specific rules for registering works created with AI. The goal of this workshop is to educate artists on the importance of registering their artworks, provide resources for them, and empower them to pursue registration without the need to hire an attorney.     "Before SCOTUS Hears Another Looted Art Case, Should Congress Reform the Foreign Sovereign Immunities Act?" by Joseph G. Scapellato is now available on our website. Claimants face substantial challenges in recovering art looted during historical injustices in U.S. courts. They must locate lost works from an evidentiary record affected by forcible displacement and prove clear title from the same tainted records.
