CAIDP Launches Call to Nations - Sign and Ratify the International AI Treaty The Center for AI and Digital Policy (CAIDP), a global network of AI policy experts and human rights advocates, urges all nations to sign and ratify the Council of Europe's Framework Convention on Artificial Intelligence. The 46 Council of Europe member states, the European Union, and 11 non-member states (Argentina, Australia, Canada, Costa Rica, the Holy See, Israel, Japan, Mexico, Peru, the United States of America and Uruguay) negotiated the Treaty. Representatives of the private sector, civil society, and academia contributed as observers. The aim of the AI Treaty is to promote human rights, democracy, and the rule of law, while encouraging technological progress and innovation. The AI Treaty is open to all nations. More than 35 nations have already signed the AI Treaty. The AI Treaty makes clear that activities within the lifecycle of AI systems must comply with these fundamental principles: ? Human dignity and individual autonomy ? Equality and non-discrimination ? Respect for privacy and personal data protection ? Transparency and oversight ? Accountability and responsibility ? Reliability ? Safe innovation The AI Treaty sets out foundational safeguards for the operation of AI systems. These requirements include: ? Public documentation regarding the use of AI systems ? Effective procedural safeguards to ensure transparency and accountability ? Contestability mechanisms to review adverse decisions by AI systems ? Impact assessments and prohibitions for certain AI systems ? Notice that one is interacting with an AI system The AI Treaty covers the use of AI systems by public authorities – including private actors acting on their behalf – and private actors. Parties also have options to comply with the principles and obligations set out in the AI Treaty when regulating the private sector. Parties are not required to apply the provisions of the Treaty to activities related to the protection of their national security interests. Still, they must ensure that such activities respect international law and democratic institutions and processes. ?? CAIDP Advises G20 Nations on AI Policy In advance of the meeting of the G20 Sherpas, the Center for AI and Digital Policy offered several recommendations for the G20 Nations concerning AI policy. In past statements on AI, the G20 has aimed to foster public trust, create an open and fair environment, and safely advance innovation. The G20 has repeatedly committed to protecting vulnerable groups and fundamental freedoms Building on recommendations that CAIDP made previously, CAIDP said the G20 Nations should: ?? ?? ?? Prohibit AI systems that violate fundamental human rights ?? ?? ?? Enact laws to ensure algorithmic transparency such that users will know when and how they are interacting with an AI system and can effectively challenge faulty or biased outcomes ?????? ?? ?? Require human oversight for all AI systems ?? ?? ? Terminate AI systems if human control is no longer possible, or if the system fails to uphold human rights; ??? ?? ??? Sign the Council of Europe AI Convention on Human Rights and the Rule of Law In 2021, CAIDP urged the G20 to take concrete steps to ensure fairness, accountability, and transparency for the deployment of AI systems. In 2022, CAIDP applauded the G20 for addressing “digital divides, privacy, data protection, intellectual property rights, sustainable digital transformation." And in 2023, CAIDP recommended that the G20: ● Implement the G20 AI Guidelines.? ● Promote fairness, accountability, and transparency for AI systems, especially public services.? ● Establish best practices for AI procurement to protect fundamental rights.? ● Reduce the environmental impact of AI systems.? ● Adopt a regulatory framework for ethical impact assessments on AI systems to mitigate risks and avoid harm. CAIDP Advises FTC on Rytr Settlement, Recommends Additional Safeguards for AI-based Testimonial Generator The Center for AI and Digital Policy provides detailed comments to the Federal Trade Commission regarding a proposed settlement with Ryter, an AI-based servce "which generated consumer reviews that would almost certainly be false and deceptive." The FTC determined - ? "the review generation service generated reviews that would almost certainly be false for the users who copied them and published them online. In many instances, the resulting reviews featured details that would deceive potential consumers deciding to purchase the service or product described. The proposed complaint asserts that at least some of Rytr's subscribers utilized the service to produce hundreds and, in some cases, thousands of reviews. In the Proposed Order, the Federal Trade Commission ??? 1?? banned "Rytr from advertising, promoting, marketing, offering for sale, or selling any service dedicated to or advertised, promoted, or offered as generating consumer or customer reviews or testimonials. ??? 2?? established reporting and compliance provisions. The Center for AI and Digital Policy supported the ban on testimonial and review services. CAIDP previously highlighted the importance of consumer protection when AI systems generate misleading and deceptive content. CAIDP also provided recommendations to improve the settlement. ??? 1?? Include AI services that manipulate consumer reviews and testimonials, as well as those that generate false content ??? 2?? Require Rytr to conduct impact assessments to test for bias, discrimination and accuracy ??? 3?? Require Rytr to maintain records on the training data pertaining to AI models CAIDP also reminded the Federal Trade Commission of the pending complaint concerning OpenAI. In March 2023, the Center for AI and Digital Policy filed an extensive complaint with the FTC urging the creation of guardrails for AI services. In July 2023, The New York Times and The Wall Street Journal reported that the FTC had undertaken the investigation that CAIDP requested. ?? CAIDP Advises Nigeria on National AI Strategy ???? The Center for AI and Digital Policy submitted comments to the Nigeria?National Information Technology Development Agency (NITDA) in response to a call for contributions on the National AI Strategy.?CAIDP commended NITDA on the development of a robust national AI governance framework in this National AI Strategy. The Center for AI and Digital Policy further recommended: 1?? Shift the focus from a concentration on the economic benefits of AI to a human-centred approach in AI policy, that focuses on human rights, dignity and well-being. 2?? Leverage the Universal Guidelines for AI to ensure the development of ethical and responsible AI. 3?? Leverage UNESCO's Recommendations on the Ethics of AI in the development of a national AI policy. 4?? Include clear guidelines in the national AI policy for the development and use of generative AI. CAIDP Urges FTC to Improve Settlement with DoNotPay, Service that Claimed AI Legal Expertise The Center for AI and Digital Policy has sent detailed comments to the Federal Trade Commission regarding a proposed settlement with DoNotPay, a company that falsely claimed it could provide AI-based legal expertise. According to the FTC, "The proposed order contains provisions designed to prevent DoNotPay from engaging in these and similar acts and practices in the future. ?? "Provision I prohibits DoNotPay from representing that its Service or any other internet-enabled product or service that it offers operates like a human lawyer or any other type of professional, unless that representation is not misleading and DoNotPay possesses competent and reliable evidence to substantiate the representation. ?? "Provision II prohibits DoNotPay from misrepresenting that its Service or any other internet-enabled product or service is capable of analyzing or evaluating a website or any other document for federal and state law violations or will save consumers legal fees. This provision also prohibits misrepresentations about the features, benefits, or attributes included with the purchase of, or subscription to, any such product or service. The Center for AI and Digital Policy endorsed these provisions and made further recommendations. CAIDP said the proposed Settlement could be improved. CAIDP recommended that the Commission establish independent oversight mechanisms for DoNotPay that require: 1?? Impact assessments and lifecycle audits for AI services and systems, 2?? Accountability mechanisms for business practices, and 3?? Transparency and privacy safeguards specific to AI services Proposed settlements from the FTC are available for public comment for 30 days.
