Under Ontario’s Family Law Act, property division is meant to ensure financial fairness when a married couple separates or divorces. Each spouse either retains any property they owned before the marriage or receives credit for its value if disposed of during the marriage, but any increase in the value during the marriage is included for equalization. At separation, each spouse calculates their “net family property” by adding the assets accumulated during marriage, then subtracting any debts accumulated over the same period and the value of what they brought into the marriage. This process, called equalization, ensures both spouses share the financial growth they built together during the marriage. Here's an example of how it works: Sanjay enters the marriage with $40,000 and has a net worth of $60,000 at separation; his net family property is $20,000. Leila enters the marriage with $120,000 and has a net worth of $500,000 at separation; her net family property is $380,000. Since there’s an imbalance in net family property, the court generally requires the spouse with the higher amount to make an equalization payment to the other of one-half the difference in the parties’ net family property values. In this case, Leila would be required to make an equalization payment of $180,000 to Sanjay.
