When treatment is questioned, reactions from plaintiff’s counsel can be swift and emphatic – no one but the medical provider who ordered and carried out the treatment is in a position to know whether it was necessary.     Our recent webinar on "Understanding and using impairment in personal injury claim negotiations" was very well received. Over 250 claims professionals and defense attorneys attended. Most demands revolve around medical bills, treatment and diagnoses. The key factor for any medical professional is first understanding how an injury has affected function. This controls their diagnosis and treatment plan. Nearly all claim professionals use treatment bills as a proxy for injury severity. It is not. At Casentric we find no correlation between the objective evidence for an injury and the treatment a claimant receives. This is wrong. High medical bills should yield clear evidence of a significant injury. It typically does not, but most adjusters do not know how to convert that into negotiating leverage.     For all of you that have been told "You're not a doctor" when trying to negotiate an injury claim, I think you will find this blog useful. At every event in which we train negotiation, the most common question we get is "how can we challenge treatment necessity?" When we ask what the impediments are that adjusters face, the response is universal. Adjusters are quickly greeted by a response from plaintiff's counsel that "you are not a doctor." Aside from being frustrating, it leaves too many with the false impression that they need a doctor to refute a doctor. Don't mistake negotiation with expert testimony and don't assume that experts can talk their way around anything. Not only are you allowed to ask questions. there is no rational way to settlement if you don't. The blog will give you more insight why this response is best: "If you don't know whether the evidence you provided proves medical necessity, what are you asking me to evaluate?"
