REALTOR? advocacy at the state level working for Massachusetts homeowners:
I'm so proud to have worked on revising Massachusetts law on home equity theft. With yesterday's budget enactment, we have a new statute that protects homeowners. First, a quick history lesson: Before yesterday, Massachusetts law allowed municipalities to charge usurious 16% interest rates and seize your home (and all of its equity) for unpaid property taxes. This created situations where homeowners would lose their single greatest asset (the median home value in Massachusetts is over $600,000) for a few thousand dollars in debt. The law was lax on process and notice requirements. Just over a year ago, the US Supreme Court declared this practice an unconstitutional taking in a case argued by Pacific Legal Foundation. Since then, Massachusetts Association of REALTORS? advocated across all three branches of government. We worked with PLF to submit amicus briefs in two pending state cases and partnered with ACLU of Massachusetts, Boston Bar Association, Greater Boston Legal Services, National Consumer Law Center, and Pioneer Institute for Public Policy Research to pursue legislative reform. The FY2025 budget language creates significant protections for homeowners to stay in their homes, increases flexibility to pay back municipalities, and maximizes their equity if a sale is needed. Most notably, it requires municipalities or debt purchasers wishing to sell a home to list it with a real estate licensee rather than sell it at auction. The Affordable Homes Act - aka the Housing Bond Bill - has passed both the Massachusetts House and Senate. However, there were different provisions in each bill requiring it to go to a conference committee to iron out the differences, which is where it currently stands. Versions of the bill contain many REALTOR? priorities, including the authorization of first-time home buyer savings accounts, by-right Accessory Dweeling Units provisions and unwinding merged lots along with many more. I pulled together some data points I took out of the Cape Cod real estate market's year-end report and put some analysis around it. The short of it: The market is still suffering from major inventory shortages that are exacerbated by homeowners in low-interest rate loans and the amount of buyers the market borrowed in 2020 and 2021. The total dollar volume still passed pre-COVID bump levels despite the number of transactions being way down as real estate continues to show its importance to the overall Cape Cod economy.
