?? Big News for Asset-Based and Factor Lenders in California ?? Secured Finance Network published its latest newsletter detailing the CA Assembly Judiciary Committee's vote in favor of amending CA SB 1235 disclosure law. This amendment introduces a safe harbor, protecting asset-based lenders and factors who provide a good faith estimate of APR in compliance with regulations from any liability if the estimate differs from the actual APR. This win addresses fundamental challenges California asset-based and factor lenders faced in using APR as a basis for secured finance product comparisons. It also opens doors for further discussions on APR construct challenges. This vital concession was achieved thanks to unwavering support from SFNet members and the asset-based lending community. We extend gratitude to Chris Nommensen of Camel Financial and SFNet's CEO, Richard Gumbrecht, for the positive outcome. The significance of this victory positively influences state disclosure laws and fostering access to capital during critical economic times.
