EPA asserts right to regulate DOT-governed activities A federal judge last year fined Washington-based transloader Multistar for violations of Clean Air Act and EPCRA requirements in a case involving the definitions of ‘in-transit’ and ‘storage incidental to transportation’ that could set a problematic precedent with lasting repercussions for tank car, container, and trailer operations. By Jason McDaniel A district court last year ordered family-owned Multistar Industries to?pay an $850,000 fine for seven total violations?of requirements in the U.S. Environmental Protection Agency’s Clean Air Act?Risk Management Program, and?Emergency Planning and Community Right-to-know Act?related to the “storage” of a customer’s chemical tank cars at?Multistar’s rail-to-truck transload facility in Othello, Washington. Multistar appealed?the decision?to the U.S. Court of Appeals for the Ninth Circuit on multiple grounds, including that the “storage” in question actually is “storage incidental to transportation,” and, most importantly, EPA holds no authority over its Department of Transportation-regulated transloading operation under the terms of?a 1971 memorandum of understanding?between DOT and EPA that establishes the policies and guidelines related to the definition of a transport facility. Oral arguments in the appeal are set for Nov. 20 in Seattle. “EPA’s interpretation is not reasonable because EPA lacks transportation expertise,” asserted Daniel Shelton, president of HazMat Resources—a hazardous materials transportation consultancy firm assisting Multistar—who spent 17 years with DOT, where he served as national hazmat cargo tank program manager. “They are not the competent authority for transportation.” Follow the link for more: https://lnkd.in/gauSrZnc

Here we go again ... New wave? FMCSA publishes eighth Intellistop exemption application By Jason McDaniel The?Federal Motor Carrier Safety Administration?finally is moving a little faster. The agency took five months to publish?the first round?of seven exemption applications for?Intellistop’s pulsating brake lamp module in the Federal Register in February 2023—and only?approved the sixth one, from?Encore Building Products, last month. But FMCSA posted the latest exemption request from?Casey's on?Oct. 22, less than three months after?it was submitted. “They were telling me the whole process would take six to eight months, so I honestly didn’t have a lot of hope it would publish this soon,” Keith Lamfers, Casey’s transportation and distribution manager, and the Midwest region chair for National Tank Truck Carriers’?Safety and Security Council, told?Bulk Transporter. “They did say, though, this is the quickest part. Request for comments is a 30-day period, and the review and follow-up are based on the number of applications in front of us.
