In July 2024, the Michigan Supreme Court clarified the rule for who can be an expert in a medical malpractice case. The medical expert rule, MCL 600.2169, was last interpreted by the Court in 2006 in Woodard v. Custer. In its most recent decision, Stokes v. Swofford, the Court held that Woodard was wrongly decided in part because it had inappropriately imposed restrictions on experts beyond the statutory language.
