Partner Eve Hill and co-counsel from Disability Rights Advocates have filed a federal lawsuit against the New York State Unified Court System and the Kings County Commissioner of Jurors on behalf of Albert Elia, a blind Brooklyn resident, and the National Federation of the Blind of New York State for systemic discrimination against blind individuals who report for jury duty. Despite meeting all the requirements to serve as a juror, the Court excluded Mr. Elia from deliberating on cases that involved video or photo evidence, under the incorrect and harmful assumption that he could not interpret that evidence because he is blind, ultimately dismissing him altogether. We were proud to celebrate the extraordinary career of retired Partner Joshua Treem at a Maryland State Bar Association Section of Criminal Law and Practice reception on March 19. Josh is the recipient of the Robert C. Heeney Memorial Award, given annually to an individual who exemplifies the highest professional standards and achievement in the field of criminal law and practice during their distinguished careers. The annual Symposium is the leading disability law conference in the United States. Brown, Goldstein & Levy partner Eve Hill, attorney Erin O'Neill, and Disability Rights Fellow Julie Orozco – along with co-counsel from Disability Rights of West Virginia – are representing the National Federation of the Blind, the National Federation of the Blind of West Virginia, and two blind graduate students in a federal lawsuit against the West Virginia University Board of Governors, alleging that the University systematically denies blind students equal access to its educational programs, services, and activities.
