    7 rules of 1031 exchange: ??Time Constraints:You must identify a replacement property within 45 days of selling your original property. You must close on the replacement property within 180 days of selling the original property. ??Like-Kind Requirement: The replacement property must be of "like-kind" to the original property. This generally means both properties must be held for investment or business use. ??Equal or Greater Value: The replacement property must be of equal or greater value than the original property. ??Qualified Intermediary:A qualified intermediary (QI) must facilitate the exchange to ensure tax deferral. The QI holds the proceeds from the sale of the original property and handles the purchase of the replacement property. ??Prohibited Transactions: You cannot directly receive or use the proceeds from the sale of the original property. They must be held by the QI. You cannot have a beneficial interest in the replacement property before the exchange. ??Boot and Reverse Exchanges: If the replacement property is worth less than the original property, you will owe capital gains tax on the difference, known as "boot." In a reverse exchange, you can acquire the replacement property before selling the original property, but you must still meet the 45-day identification and 180-day acquisition periods. ??Documentation: You must maintain detailed records of the exchange, including the identification of replacement properties, the role of the QI, and the transfer of title.
